Terms of Service
Effective March 25, 2026 · Florida, United States · Game Server Hosting
By creating an account or using any Gravel Host service, you agree to be bound by these Terms. Read them carefully. If you do not agree, do not use our services.
1.1 Agreement & Definitions
These Terms form a legally binding agreement between you ("Customer") and Gravel LLC ("Gravel Host", "we", "us"). They govern all use of our game server infrastructure, control panels, and related services (the "Services").
Services: Game server hosting, management tools, control panel access, and related products.
Customer Data: Any data, files, configs, or content you upload, store, or transmit via the Services.
Authorized User: Any individual you grant access to the Services under your account.
Prohibited Content: Any content or activity that violates Section 1.4 of these Terms.
Subscription: The paid or free plan under which you access the Services.
Intellectual Property: All trademarks, logos, software, and content owned by or licensed to Gravel Host.
1.2 Services
We grant you a limited, non-exclusive, non-transferable right to access the Services during your Subscription solely for lawful purposes under these Terms.
We may update, modify, or discontinue any part of the Services at any time. Material changes that reduce functionality will be announced at least 14 days in advance via email or your dashboard.
Uptime & Availability. We target high availability but do not guarantee uninterrupted service. Scheduled maintenance, third-party network issues, and events outside our control may affect availability. Maintenance windows will be announced at least 24 hours in advance where possible.
Intellectual Property. All software, interfaces, documentation, and branding are the exclusive property of Gravel Host or its licensors. Nothing in these Terms transfers IP rights to you. You may not copy, modify, distribute, or reverse-engineer any part of the Services without our written consent.
1.3 Account Responsibilities
You are responsible for keeping your credentials confidential and for all activity on your account. Report any suspected unauthorized access immediately via a support ticket on our Discord or at support@gravelhost.com.
You represent that you are at least 16 years old and have legal authority to enter into these Terms. If acting on behalf of an organization, you confirm you have authority to bind it.
Violations of these Terms by any Authorized User you grant access to are treated as your own violations.
Security Best Practices:
Use a strong, unique password for your Gravel Host account.
Enable two-factor authentication (2FA) where available.
Never share login credentials with unauthorized parties.
Revoke Authorized User access promptly when no longer needed.
1.4 Acceptable Use
You may only use the Services for lawful purposes. The following are expressly prohibited:
Prohibited Activities:
DDoS & Network Abuse: Conducting denial-of-service attacks, port scanning, packet flooding, or any activity that disrupts network services.
Malware & Exploits: Hosting, distributing, or executing malicious code, cheats, exploits, or software designed to damage or gain unauthorized access to any system.
Illegal Content: Storing or transmitting CSAM, copyrighted material without authorization, or any content facilitating illegal activity.
Resource Abuse: Crypto mining, running non-gaming workloads not authorized under your plan, or degrading service quality for other customers.
Impersonation & Fraud: Misrepresenting your identity, impersonating Gravel Host staff, or facilitating phishing or social engineering.
Unauthorized Resale: Reselling, sublicensing, or transferring access to the Services to third parties without our written consent.
Permitted Uses:
Game Servers: Running licensed game servers for private or public multiplayer sessions.
Mods & Plugins: Installing approved mods, plugins, and server-side modifications.
Community Events: Hosting tournaments, leagues, and community gaming events.
Violations of the Acceptable Use policy may result in immediate suspension without refund. Severe or repeat violations may be reported to the relevant authorities.
1.5 Fees, Billing & Refunds
All fees are charged in advance on the billing cycle selected at checkout (monthly, quarterly, semi-annual or annual). Prices are listed on our website and subject to change with 14 days' prior notice.
Non-payment may result in suspension after a 3-day grace period.
Annual plans may be eligible for a prorated refund within 7 days of purchase. Monthly plans are non-refundable after 72 hours.
Due to the nature of digital services, all sales are final once this 72-hour period has passed or where the service has been fully used.
By completing your purchase, you expressly consent to immediate server provisioning and acknowledge that your right to a refund is limited to this 72-hour period.
Refunds are limited to one per account, for the lifetime of that account. Otherwise Refunds will only be provided in the following cases: Duplicate Payment / Service not delivered / Critical technical issue that we are unable to resolve.
All purchases of add-ons, upgrades, and one-time extras are final and non-refundable, regardless of usage or cancellation status.
Billing disputes must be raised within 30 days of the charge. Chargebacks without first contacting support may result in service termination.
Continued use after a price change constitutes acceptance of the new pricing.
1.6 Termination & Suspension
Either party may terminate these Terms at any time. You may cancel by contacting Support. We may terminate without cause upon reasonable notice, except where immediate action is warranted below.
Grounds for Immediate Action:
Violation of any provision in Section 1.4 (Acceptable Use).
Account activity that poses a security risk to Gravel Host or other customers.
Required by law or a valid legal order.
Fraudulent activity or bad-faith payment disputes.
Data Retention After Termination. We retain your Customer Data for 90 days post-termination, during which you may request an export. After that window, data may be permanently deleted. Gravel Host is not liable for data loss following this period.
1.7 Limitation of Liability
THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." GRAVEL HOST DISCLAIMS ALL WARRANTIES — EXPRESS, IMPLIED, OR STATUTORY — INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
GRAVEL HOST IS NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES — INCLUDING LOSS OF PROFITS, DATA, OR BUSINESS INTERRUPTION — EVEN IF ADVISED OF SUCH POSSIBILITY.
OUR TOTAL CUMULATIVE LIABILITY WILL NOT EXCEED THE GREATER OF (A) AMOUNTS YOU PAID IN THE 12 MONTHS PRIOR TO THE CLAIM, OR (B) $100 USD.
Some jurisdictions restrict limitation of warranties or liability. In those jurisdictions, the above applies only to the extent permitted by law.
1.8 Privacy & Data Processing
Your use of the Services is governed by our Privacy Policy at gravelhost.com/privacy, incorporated here by reference. By using the Services, you consent to data collection and use as described therein.
We process Customer Data solely to provide the Services.
We do not sell your personal data to third parties.
You retain ownership of all Customer Data. We claim no IP rights over it.
EU/EEA users may have additional rights under GDPR. Contact support@gravelhost.com for data subject requests.
1.9 Fair Use Policy
Services provided by us are not explicitly limited by bandwidth, CPU or disk space; however, we have some restrictions.
Disk space is 'unlimited' for the purpose of storing material related to your service. 100 GB of user data is acceptable. Hundreds of copyrighted music, movies or games are not.
If your service uses an excessive amount of bandwidth or CPU for prolonged periods, we will send you warnings via email. If you don't fix the problem, we may suspend your service.
If your service is using an excessive amount of disk space, we may thoroughly investigate your storage. If you are found to be using excessive disk space for material not related to your service, we will send you warnings via email. If you don't fix the problem, we'll start deleting files irrelevant to your service.
1.10 Game Swapping Policy
Customers with server plans provisioned with 8GB of RAM or more are eligible for no-cost game swapping, subject to the following terms and conditions (*):
Game swapping is available only on active server plans with 8GB RAM or higher.
Accounts must be in good standing, with no outstanding invoices or violations of our Terms of Service.
Game swapping allows customers to change the game installed on their server at no additional cost. This includes switching between any games officially supported by our platform at the time of the request.
All server data may be permanently deleted during the game swap process. It is the customer's responsibility to back up any files, saves, configurations, or databases prior to initiating a swap. We are not liable for any data loss resulting from a game change.
Game swapping is intended for reasonable use only. Excessive or abusive swapping (e.g., repeated swaps within short timeframes that impact system stability or support resources) may result in temporary or permanent restrictions. We reserve the right to define what constitutes abuse at our sole discretion.
Only games available in our control panel or offered by our platform are eligible for swapping. Requests for unsupported or custom games may be declined.
While game swaps are free, setup and deployment times may vary depending on the selected game and server load. No guaranteed completion timeframe is provided unless otherwise stated in your service plan.
Limitations. Game swapping does not include:
Custom mod installations;
Advanced configuration or optimization;
Migration of data between different game types.
* These services may be available separately and could incur additional charges. We reserve the right to modify, limit, or discontinue the no-cost game swapping feature at any time, with or without prior notice.
1.11 Governing Law & Disputes
These Terms are governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles.
Disputes arising from these Terms will be resolved through binding individual arbitration under AAA rules. Either party may bring small claims in the appropriate court for qualifying disputes.
CLASS ACTION WAIVER: You waive any right to participate in a class action lawsuit or class-wide arbitration. All disputes must be resolved on an individual basis.
1.12 General Provisions
Entire Agreement: These Terms, our Privacy Policy, and any applicable Order Form constitute the entire agreement and supersede all prior understandings relating to the Services.
Severability: If any provision is unenforceable, it will be modified to the minimum necessary extent; remaining provisions stay in full force.
Waiver: Failure to enforce any right is not a waiver. Any waiver must be in writing and signed by an authorized Gravel Host representative.
Amendments: We may update these Terms with 14 days' notice for material changes. Continued use after the effective date constitutes acceptance.
Force Majeure: Neither party is liable for failures caused by circumstances beyond reasonable control — including natural disasters, internet outages, or third-party failures.
Assignment: You may not assign these Terms without our written consent. Gravel Host may assign them in connection with a merger, acquisition, or asset sale.
By creating an account or accessing the Services, you confirm that you have read, understood, and agreed to these Terms of Service.

2.1 Marketing Communications
Gravel Host may send you marketing communications if you have asked us for information concerning our services or if you have agreed to, and have not opted out from, receiving marketing communications. You may ask us to stop sending you marketing messages at any time by following the opt-out link in any marketing message sent to you.
2.2 Disclosure of Personally Identifiable Information and Personal Data
Gravel Host will only share your Personally Identifiable Information or Personal Data under limited circumstances. Gravel Host will disclose your Personally Identifiable Information and Personal Data:
Upon your consent or at your direction;
To its subsidiaries and affiliates;
To contractors, business partners, and service providers that Gravel Host uses to support the Service;
In the event Gravel Host sells or transfers all or a part of its business or assets;
To Gravel Host's accountants, auditors, insurers, or attorneys;
In response to lawful requests from public authorities, including upon receipt of an exigent circumstances request, upon receipt of a duly authorized subpoena or court order, or where doing so is necessary to protect our users, our employees, our contractors, third parties, or property.
We will ensure that the Personal Data transferred will be used solely for the support of our service and we will maintain controls, contracts, and/or non-disclosure agreements with third parties, to ensure the correct use of information disclosure.
2.3 Legal Basis for Collection and Use of Personally Identifiable Information and Personal Data
Gravel Host collects and processes the above-described Personally Identifiable Information and Personal Data consistent with the European General Data Protection Regulation (EU GDPR), the UK Data Protection Act 2018, and the UK GDPR. Gravel Host collects this data to comply with its contractual obligations, to perform the Services, to communicate with you, and to administer its Services and business. Gravel Host's lawful ground for processing this Personally Identifiable Information and Personal Data is the following:
Your consent, when you voluntarily submit Personally Identifiable Information and Personal Data to Gravel Host;
Gravel Host's legitimate interest in providing its Services, maintaining its business records, communicating with its users, performing its contractual obligations, and growing its business through marketing efforts; and
Compliance with a legal obligation to which Gravel Host is subject.
2.4 Access, Protection, and Retention of Personally Identifiable Information and Personal Data
If you have registered an account with Gravel Host and are a citizen of the European Union, Gravel Host provides you with account settings that let you modify, correct, or delete the personal data that you have provided to us that is associated with your account. You may access these account settings at https://www.gravelhost.com/. Whether you are located in the European Union or elsewhere, to stop our collection and use of your personal data, you need only to delete your account.
If you have not registered an account with Gravel Host, we only collect technical data from you. To stop our collection and use of your technical data, you need only cease using our Services.
Gravel Host is located in the United States and we may transfer your Personally Identifiable Information and Personal Data to countries outside of the European Union. Many of our third-party service providers are located within the United States and their processing of Personally Identifiable Information and Personal Data will involve a transfer of data outside of the European Union. Whenever personal data is transferred outside of the European Union, Gravel Host does its best to ensure a similar degree of security and data privacy by requiring that its service providers and its foreign parents or subsidiaries adopt standard contractual clauses covering the transfer of this data.
Additionally, Gravel Host takes measures that supplement transfer tools, such as standard contractual clauses, to ensure compliance with the level of protection of personal data in the European Union. For example, when Gravel Host receives an expedited circumstances request, a subpoena, a warrant, or a court order to disclose personal data from law enforcement or regulators in the United States, Gravel Host carefully validates these requests, including by reviewing the legality of such request, subpoena, warrant, or court order and challenging them if there are grounds under the law to do so before any personal data is disclosed.

Refund Policy

This Refund Policy governs all refund and billing dispute requests for Gravel Host game server services. By purchasing a service, you acknowledge and agree to the terms herein. Please read this document carefully before completing any purchase.
3.1 Definitions
The following terms apply throughout this Refund Policy:
Refund Window: The 72-hour period following initial purchase during which a standard refund may be requested.
Administrative Fees: Payment processing costs (e.g. credit card or PayPal fees) deducted from eligible refunds.
Credit Refund: A refund issued as account balance credit rather than returned to the original payment method.
Subscription: Any paid or free recurring hosting plan purchased through Gravel Host.
Add-On: Any one-time upgrade, feature, or extra purchased separately from a Subscription.
Chargeback: A payment reversal initiated through a bank or payment provider without first contacting Gravel Host support.
3.2 General Refund Policy
Due to the nature of digital services and the immediate provisioning of game server infrastructure upon purchase, all sales are considered final once the applicable refund window has passed or the service has been fully utilized.
By completing a purchase, you expressly consent to the immediate provisioning of your server and acknowledge that your right to a refund is limited as described in this Policy.
Refund Method & Timing:
Account Credit: Applied instantly to your Gravel Host account balance.
PayPal Refunds: Allow up to 5 business days for the amount to be returned to your PayPal balance.
Credit / Debit Card: Allow up to 7 business days for the refund to appear on your card statement.
Gravel Host reserves the right to issue refunds as account credit rather than to the original payment method, at its sole discretion, unless otherwise required by applicable law.
3.3 Refund Eligibility
72-Hour Money-Back Guarantee. New customers who are unsatisfied within the first 72 hours of their initial purchase may request a full refund, minus applicable Administrative Fees. The following conditions apply:
This guarantee is valid for one (1) service per customer, for the lifetime of their account.
Only applies to products that do not offer a free trial at the time of purchase.
Hosting packages (game server plans) qualify under this guarantee.
Service renewals are not covered by the 72-hour guarantee.
The refund covers the full purchase amount minus Administrative Fees such as payment processing charges.
Annual Plan Proration. Customers on annual billing plans may be eligible for a prorated refund if a cancellation request is submitted within 7 calendar days of the annual plan purchase date. Prorated refunds are calculated based on unused time remaining in the billing cycle, minus Administrative Fees.
Monthly Plans. Monthly plans are non-refundable after the 72-hour guarantee window has elapsed. Once 72 hours have passed from the purchase time, no refund will be issued for monthly subscriptions except under the circumstances listed in Section 3.4.
Excluded Products. The following products and services are expressly excluded from all refund eligibility, including the 72-hour guarantee:
Domain Name Registrations
SSL Certificates & Website Builders
Email Security products
Dedicated Servers and Virtual Private Servers (VPS)
Service renewals of any type
Add-ons, upgrades, and one-time extras — these are final and non-refundable regardless of usage or cancellation status
3.4 Exception-Based Refunds
Outside of the 72-hour window and the annual plan proration period, refunds will only be considered in the following documented circumstances:
Grounds for Exception Refunds:
Duplicate Payment: You were charged more than once for the same service within the same billing cycle due to a system error. Evidence of duplicate charges is required.
Service Not Delivered: Your server or service was never provisioned and remained inaccessible despite payment being collected. A support ticket must be opened first.
Critical Unresolvable Issue: A critical technical fault attributable solely to Gravel Host infrastructure that our team is unable to resolve within a reasonable timeframe. This does not include issues resulting from customer configuration, third-party mods, or upstream game software.
Gravel Host reserves the right to determine, at its reasonable discretion, whether a reported issue qualifies under the above exceptions. All exception refund requests must be submitted via a support ticket before any chargeback or payment dispute is initiated.
3.5 Account Refund Limit
Refunds under the 72-hour guarantee are limited to one (1) refund per account for the lifetime of that account. Subsequent refund requests will only be considered under the exception criteria outlined in Section 3.4.
This limit applies regardless of the number of services purchased, account age, or payment method used.
3.6 Billing Disputes & Chargebacks
Raising a Dispute. Billing disputes must be raised within 30 days of the charge appearing on your account or payment statement. To raise a dispute, contact our billing team by opening a ticket in the Gravel Host Discord Community Server.
Chargeback Policy. Filing a chargeback or payment reversal with your bank or payment provider without first contacting Gravel Host support will result in immediate service suspension and may also lead to permanent account termination.
Gravel Host reserves the right to dispute any chargeback that does not meet the exception criteria in Section 3.4, and to report fraudulent chargeback activity to relevant payment processors.
Price Changes. Gravel Host may update pricing with 14 days' prior notice. Continued use of the Services after the effective date of a price change constitutes acceptance of the revised pricing. Price changes do not entitle customers to a refund on existing billing cycles.
Step 2: Include your account email, order number, the service in question, and the reason for your request.
Step 3: Our billing team will review your request and respond within 3 business days.
Step 4: If approved, your refund will be processed via the method described in Section 3.2 (*) within the stated timeframes.
* (1) Refund requests submitted via social media, Discord direct messages, or any channel other than official support tickets may not be processed.
* (2) Gravel Host will never issue a refund without the customer first confirming their preferred refund method (account credit or original payment method).
3.8 Governing Law
This Refund Policy is governed by the laws of the State of Florida, United States, without regard to conflict-of-law principles. Any disputes arising from this Policy are subject to the dispute resolution terms outlined in the Gravel Host Terms of Service, including binding individual arbitration under AAA rules.
By purchasing any Gravel Host service, you confirm that you have read, understood, and agreed to this Refund Policy.

Service Level Agreement
99.9% network uptime
4.1 Uptime Commitment
Gravel Host provides a 99.9% network and power uptime commitment for all hosting services, excluding scheduled maintenance windows or emergency interventions required to protect the stability, security, or integrity of our systems. This uptime applies to the underlying hosting environment and not to user-installed software, mods, game versions, or third-party content.
4.2 Support Response Times
Gravel Host offers support through tickets and live chat. While response times may vary based on volume, we strive to respond to:

Chargeback and dispute response times may be extended due to processing delays imposed by Stripe and PayPal, which are outside of our control.
Support does not include custom game development, debugging of third-party plugins, repairing corrupted mod files, or troubleshooting issues caused by unsupported software. Gravel Host does not provide official ASA/ARK: Survival Ascended hosting and only supports user-configured VPS environments in accordance with the any agreement.
4.3 Service Delivery & Maintenance
When a hosting service is purchased, provisioning typically occurs instantly. In rare cases involving system load or fraud verification, activation may take longer. Gravel Host may perform routine maintenance to upgrade hardware, software, or network infrastructure. Scheduled maintenance will be communicated when possible and will not count as downtime under this SLA.
4.4 Outages, Credits, and Limitations
If Gravel Host fails to meet the uptime guarantee, clients may request service credits. Credits are based on the percentage of monthly service fees corresponding to the affected service and are limited to the value of that service for the billing period. SLA credits must be requested within 7 days of the event and cannot be exchanged for refunds.
This SLA does not apply to outages resulting from:
User-installed mods, plugins, scripts, or game configurations
Actions taken by the customer, such as misconfiguration or resource exhaustion
Issues caused by external providers (Steam, third-party APIs, or unsupported game versions)
Force majeure events including natural disasters or internet backbone failures
Services on VPS machines running customer-managed software, in full compliance with the any agreement
4.5 Customer Responsibilities
Customers are responsible for maintaining secure passwords, managing backups, updating their servers, and ensuring that any uploaded content complies with applicable laws and third-party licensing terms. Gravel Host does not restore data lost due to user error, unsupported modifications, or corrupted files.
By using Gravel Host's services, you acknowledge that certain games or platforms may have licensing restrictions, and you agree that Gravel Host does not provide or advertise official game server hosting for titles reserved under exclusive agreements such as ARK: Survival Ascended. Any server setup for such titles must be done solely through customer-managed VPS instances.
Gravel Host reserves the right to update this SLA to reflect changes in service offerings, industry standards, or contractual obligations, including those related to compliance with external partners and licensors within any agreement.
